Terms and Conditions for Modak’s HOLD ‘EM

Introduction

These terms and conditions govern Modak’s HOLD ‘EM Strategy.  By using our services, you agree to comply with and be bound by these terms. If you do not agree with any part of these terms, please do not use our services and or participate in the campaign.

Modak will publicly share a promotional video on its official Instagram and TikTok accounts.

Eligibility

1. Participants must tag the famous and successful celebrity @Beyonce in the video in the platform TikTok and/or Instagram.
2. Participants must sign up on Modak using the code MODAKHOLDEM.
3. All individuals who sign up with the code MODAKHOLDEM will enter a raffle for Beyoncé swag.
4. Participants must be US citizens.
5. In the case of participants aged 13-17, the account must be held by their parent or legal guardian.
6. Parents or guardians participating in the promotion must have a dependent teenager aged 13-17.

Limits/exceptions:

1. This promotion is exclusively valid within the United States.
2. The same person cannot win more than 1 product. There will be 15 different winners.
3. This initiative is spearheaded by Modak. Beyoncé is not associated with or involved in this endeavor.
4. Modak can send the prize within 5 business days after announcing the winner.

Promotion Period This campaign will be active between March 4, 2024, and March 25, 2024.

Those interested in continuing to comment on the video may do so, but the raffle will take place on March 25, 2024, through Modak’s Instagram (@modakmakers).

Prize

• Modak will be raffling off 15 Beyoncé products/swag.
• There will be 15 different winners.
• There will be 15 Modak’s choice products, all representing Beyoncé. The products will be chosen by Modak based on stock availability (examples of products: stickers, t-shirt, cap, necklace, pants - all featuring Beyoncé).

Liability and Disputes

• Modak is not responsible for entries not received for whatever reason.
• Any disputes relating to this Promotion will be subject to the exclusive jurisdiction of the courts of the state in which Modak operates.

Representations

By participating in this strategy (or if you are a parent or legal guardian authorizing a minor to participate in the Modak’s HOLD ‘EM Strategy), you represent and warrant that (i) you are a natural person; (ii) you are at least 13 years of age (or older if you reside in a state where the age of majority is older); (iii) you are a legal resident of the United States; and (iv) you agree to abide by these Terms.

Privacy.

Any personal information you make available to us in connection with the Modak’s HOLD ‘EM Strategy may be collected, used, and shared by us by Modak Makers’ Privacy Policy, which is available at https://www.modakmakers.com/legal/privacy.

Verification.

• Modak reserves the right to disqualify any participant who violates the terms and conditions or engages in fraudulent activity.
• Modak is not responsible for any technical issues, including but not limited to, internet outages, that may affect participation in the campaign.
• The strategy is subject to all applicable laws and regulations.
• By participating in this strategy, participants agree to abide by these terms and conditions. Modak reserves the right to amend or cancel the strategy at its discretion. Participants are encouraged to review Modak’s privacy policy and terms of service.
• The prize is redeemable within a period of up to 3 weeks from the date of winner announcement. Failure to redeem the prize within this timeframe will result in forfeiture of the prize.

Termination and Changes.

Modak Makers may suspend or terminate the Modak’s HOLD ‘EM Strategy or a user’s ability to participate in the Modak’s HOLD ‘EM Strategy at any time for any reason. We reserve the right to suspend accounts or remove rewards if we notice any activity that we believe is abusive, fraudulent, or in violation of the Modak Makers Terms of Service or these Terms.

Updates to the Terms.

We can update these Terms at any time without prior notice. If we modify these Terms, we will post the modification on the Websites or in the Application, which are effective upon posting. Continued participation in Modak’s HOLD ‘EM Strategy after any modification shall constitute consent to such modification.

Governing Law.

The laws of the State of California will govern these Terms, as well as any claim, cause of action, or dispute that might arise between you and Modak Makers, without regard to conflict of law provisions.
